All your songs, recordings, and settings are stored locally on your device. We do not have access to this data. If you uninstall the app, this local data will be deleted.

TuneSplash does not integrate with any third-party analytics, advertising, or tracking services.

TuneSplash is suitable for all ages. We do not knowingly collect any information from anyone, including children under 13.

1. Acceptance of Terms
By downloading, installing, or using TuneSplash ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not download, install, or use the App. Your use of the App constitutes your acceptance of these Terms and any future modifications.
2. Use at Your Own Risk
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU EXPRESSLY AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK. TuneSplash makes no representations or warranties of any kind, express or implied, regarding the App's operation, accuracy, reliability, or suitability for any particular purpose. We do not warrant that the App will meet your requirements, be uninterrupted, timely, secure, or error-free.
3. Description of Service
TuneSplash is a free music creation application that allows users to create music by humming melodies, drawing notes, recording vocals, and creating drum patterns. The App transforms these inputs into playable music using various virtual instruments.
4. User Content and Intellectual Property Compliance
Your Content: You retain full ownership of all original music and recordings you create using TuneSplash. However, you are solely responsible for ensuring that your use of the App and any content you create, distribute, or share does not infringe upon the intellectual property rights of any third party.
Third-Party Rights: You agree NOT to use TuneSplash to:
Reproduce, sample, or recreate copyrighted music, melodies, or compositions owned by others without proper authorization
Create content that infringes upon any copyright, trademark, patent, trade secret, or other proprietary rights of any third party
Distribute, sell, or commercially exploit any content that violates intellectual property laws
Claim ownership of music or melodies that belong to others
You acknowledge and agree that TuneSplash bears no responsibility for any intellectual property infringement committed by users. Any legal consequences arising from your infringement of third-party intellectual property rights are solely your responsibility.
5. Indemnification
You agree to indemnify, defend, and hold harmless TuneSplash, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any rights of any third party, including intellectual property rights; (d) any content you create, upload, or share using the App; or (e) any claim that your content caused damage to a third party.
6. License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, non-sublicensable license to download, install, and use TuneSplash on devices you own or control, solely for personal or commercial music creation purposes.
7. Restrictions
You agree not to:
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
Modify, adapt, translate, or create derivative works based on the App
Use the App for any unlawful, fraudulent, or malicious purpose
Distribute, sublicense, lease, rent, or transfer the App or your rights to any third party
Remove, alter, or obscure any proprietary notices in the App
Use the App in any manner that could damage, disable, or impair its functionality
8. Intellectual Property of TuneSplash
The App and its original content, features, functionality, design, and underlying technology are owned by TuneSplash and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Nothing in these Terms grants you any right to use TuneSplash's name, logo, or trademarks.
9. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TUNESPLASH EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TUNESPLASH DOES NOT WARRANT THAT THE APP WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TUNESPLASH, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER TUNESPLASH WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL TUNESPLASH'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO TUNESPLASH (IF ANY) FOR USE OF THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. No Professional Advice
The App is a creative tool and does not provide legal, financial, or professional advice. Any decisions you make based on your use of the App are made at your own risk and discretion.
12. Changes to Terms
We reserve the right to modify, amend, or update these Terms at any time in our sole discretion. Changes will be effective immediately upon posting the updated Terms. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
13. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity of the remaining provisions.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TuneSplash regarding your use of the App and supersede all prior agreements and understandings.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction, at TuneSplash's sole discretion.
